Terms of Service for Hawthorne & Vale Electrical Services Ltd

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern the provision of electrical services by Hawthorne & Vale Electrical Services Ltd (referred to as “we”, “us”, “our”, or the “Company”) to customers, clients, property owners, landlords, tenants, contractors, and other users of our services (referred to as “you” or “your”).

By requesting a quotation, booking an appointment, accepting a quotation, allowing our operatives to commence work, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all services provided by Hawthorne & Vale Electrical Services Ltd, including electrical fault finding and repairs, fuse board upgrades and replacements, indoor and outdoor lighting installation, socket, switch, and wiring installation, EICR safety inspections, emergency call-outs, and landlord electrical maintenance.

2. Scope of Services

We provide local electrical services in accordance with applicable professional standards, safety requirements, and the information available to us at the time of service. Our services may include, without limitation:

  • Electrical fault finding and repairs;
  • Fuse board upgrades and replacements;
  • Indoor and outdoor lighting installation;
  • Socket, switch, and wiring installation;
  • Electrical Installation Condition Reports (EICR) safety inspections;
  • Emergency call-outs;
  • Landlord electrical maintenance;
  • Related inspection, testing, certification, and remedial works agreed in writing.

All works are subject to a site assessment and may require additional materials, labour, testing, access arrangements, isolation of power, or follow-up visits. Any quote or estimate provided is based on the information available at the time and may be revised if unforeseen issues, hidden defects, unsafe conditions, or additional work are identified.

We may refuse to carry out or continue work where, in our reasonable opinion, the site conditions are unsafe, access is insufficient, the required permissions are not in place, or the work requested would breach legal, regulatory, or safety requirements.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate and complete information about the property, the issue, and any known hazards;
  • Ensure safe, reasonable, and timely access to the property, electrical equipment, and work areas;
  • Obtain all necessary permissions, consents, landlord approvals, leaseholder permissions, and access rights;
  • Disclose any known asbestos, water ingress, fire damage, infestation, structural defects, or other hazards;
  • Ensure that valuable, fragile, or sensitive items are moved or protected as needed before work begins;
  • Keep children, pets, and unauthorised persons away from work areas during service delivery;
  • Not tamper with, modify, or reconnect any equipment, wiring, or circuits after our work without proper qualification;
  • Make payment in accordance with the agreed terms;
  • Comply with all reasonable instructions provided by our staff or contractors for health and safety purposes.

You are responsible for ensuring that any pre-existing electrical installation or equipment is suitable for inspection, testing, repair, or replacement. We are not responsible for delays, additional charges, or inability to complete work caused by inaccurate information, lack of access, or failure to fulfil these obligations.

4. Payment Terms and Conditions

Unless otherwise agreed in writing, fees are payable in pounds sterling (GBP). We may require a deposit, payment in advance, payment on completion, or staged payments depending on the size, complexity, urgency, or materials required for the job.

  • Quotations are valid for the period stated in the quotation or, if not stated, for a reasonable period only.
  • Estimates are indicative and may change if the scope of work changes or unforeseen defects are discovered.
  • Emergency call-outs, out-of-hours work, weekend work, and urgent attendance may attract additional charges.
  • Materials, parts, parking charges, congestion charges, disposal fees, and other third-party costs may be added where applicable.
  • Invoices are due on receipt unless a different due date is specified in writing.
  • Late or overdue payments may result in suspension of further work, recovery action, and reasonable collection costs.

Title to any goods or materials supplied by Hawthorne & Vale Electrical Services Ltd remains with us until payment has been received in full, to the extent permitted by applicable law.

If you dispute any invoice, you must notify us promptly in writing, providing full details of the issue. You remain responsible for paying any undisputed portion of the invoice by the due date.

5. Cancellation and Refund Policy

You may cancel a booking by giving us reasonable notice. Where a cancellation occurs after we have incurred costs, reserved time, ordered materials, or commenced attendance, you may be liable for a cancellation fee or for costs reasonably incurred.

  • Cancellations made before any preparatory work or material orders may not incur a charge, at our discretion;
  • Cancellations made with short notice may be subject to a cancellation fee;
  • If our operatives attend and are unable to complete work due to access issues, inaccurate information, or unsafe conditions, a call-out fee and any reasonable costs may still apply;
  • Refunds, where applicable, will be assessed on a case-by-case basis and may exclude work already carried out, materials supplied, and non-recoverable third-party costs.

Where services have been fully performed with your prior agreement, you may not be entitled to a refund except where required by law. Any refund due will ordinarily be processed using the original payment method within a reasonable period after approval.

For emergency call-outs, you acknowledge that immediate attendance, diagnostics, and risk mitigation may commence promptly and may be non-refundable once the service has started.

6. Liability Limitations

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

Subject to the foregoing, Hawthorne & Vale Electrical Services Ltd shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive losses;
  • Loss of profit, revenue, business, contracts, goodwill, or anticipated savings;
  • Loss or corruption of data;
  • Damage caused by pre-existing defects, hidden faults, defective installations, or third-party interference;
  • Delay or failure caused by supplier shortages, access issues, unsafe conditions, or events outside our reasonable control;
  • Any loss arising from your failure to follow our instructions or to maintain your installation properly.

Our total aggregate liability arising out of or in connection with any service, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the amount paid or payable for the specific service giving rise to the claim, except where a different limit is required by applicable law.

You acknowledge that electrical systems may contain hidden defects that cannot be identified without invasive investigation, and that testing may reveal pre-existing issues unrelated to our work. We do not guarantee that all faults can be detected or that future failures will not occur.

7. Intellectual Property Rights

All intellectual property rights in our website content, quotations, reports, checklists, templates, branding, diagrams, photographs, documents, and written materials produced by Hawthorne & Vale Electrical Services Ltd remain our property or the property of our licensors, unless expressly agreed otherwise in writing.

Subject to full payment, you are granted a limited, non-exclusive, non-transferable licence to use any reports, certificates, or other deliverables we provide solely for your internal, domestic, property management, compliance, or evidential purposes in relation to the relevant property.

You must not copy, reproduce, distribute, alter, publish, or commercially exploit our materials without our prior written consent, except where permitted by law.

8. Data Protection and Privacy

We collect and process personal data in connection with enquiries, bookings, service delivery, invoicing, compliance, record-keeping, communication, and legal obligations. This may include names, contact details, property information, service history, and payment-related information.

We will handle personal data in accordance with applicable data protection and privacy laws. We may share information with suppliers, subcontractors, insurers, accountants, legal advisers, payment processors, or regulatory authorities where necessary and lawful.

You confirm that any personal data you provide is accurate and, where you provide personal data relating to another person, that you have the authority or legal basis to share it with us.

For further details on how we use personal data, you should refer to any separate privacy notice we provide or publish. If there is any inconsistency between these Terms and a privacy notice regarding data handling, the privacy notice will prevail to the extent of the inconsistency.

9. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events or circumstances beyond our reasonable control, including but not limited to severe weather, flooding, fire, industrial disputes, transport disruptions, power failures, supply shortages, public health emergencies, government action, civil unrest, acts of terrorism, or accidental damage not caused by us.

If a force majeure event occurs, we may suspend or reschedule services without liability, and we will use reasonable efforts to resume performance as soon as practicable.

10. Changes to Terms

We may update or amend these Terms from time to time to reflect changes in our business, services, legal requirements, or operational practices. Any revised version will take effect from the date stated in the updated Terms or, if no date is stated, when published or otherwise communicated to you.

The version of the Terms in force at the time you book or accept a service will ordinarily apply to that service, unless a later variation is agreed in writing or a change is required by law.

11. Applicable Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or formation shall be governed by and construed in accordance with the laws applicable in the United Kingdom, and, where relevant, the laws of England and Wales.

Subject to any mandatory legal rights, the courts having jurisdiction over England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms or the services provided by Hawthorne & Vale Electrical Services Ltd.

13. Severability Clause

If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable, or, if such modification is not possible, it shall be severed from these Terms.

The remaining provisions shall continue in full force and effect. Any failure by us to enforce a right or provision under these Terms shall not constitute a waiver of that right or provision.
